Policies & Procedures
Call in Policy
A Provider must call in to CAN each time they are not participating.
For a scheduled meal time such as: Breakfast, Lunch, Snack, or Supper
For the day, week, or vacation.
When there are no NON-RESIDENT children present.
A hand written letter, 3 days prior to becoming inactive, is acceptable.
Telephone Service
All Providers must have telephone service, anyone that does not have telephone service, must have a contact number.
Failure to report a disconnected telephone will immediately result in an inactive status (See MEMO dated 7/11/2011).
If you do not have LOS (Local Option Service) a calling card is needed.
When CAN makes a call to the Provider, they have 3 hours to return our call or they will become INACTIVE until we receive a phone call back. (CAN NOT CLAIM MEALS, see MEMO dated 7/11/2011).
General Errors
Sponsor will use discretion in determining whether a problem or error rises to the level of Serious Deficiency. A common sense approach shall be made with regards to the frequency of the errors as well as the severity of the error.
When general errors occur as listed below; the following corrective actions shall apply
Error in general meal planning
Error in completing and maintaining the daily meal count and attendance report
Any other general errors related to program non-compliance
1st OFFENSE
Disallow the meals which do not meet the USDA guidelines. Provide Technical Assistance (TA) on meal patterns and guidelines. Closely monitor Provider’s future menus and meal count and attendance report to ensure the Provider has a clear understanding and knowledges of the Program Requirements
2nd OFFENSE
Sponsor to provide formal on-site re-training as to the rules and regulations, menus, meal count, and attendance, and to ensure the Provider has a complete understanding and knowledge of the program requirements. Conduct more frequent follow-up reviews to show an immediate improvement and show full compliance in a reasonable time period.
3rd OFFENSE
Sponsor to begin Seriously Deficient Process and/or Termination Process.
Training
A New Provider or Recert Provider will be trained using the Acknowledgement of New Provider Training List
Each Provider will be given technical assistance (TA) and training during monitoring visits as needed
All Providers are required (MANDATORY) to attend the Annual Training Session scheduled by the Sponsor (CAN). If a Provider does not attend the training, he/she will be required to attend the second training session, which will be scheduled within 3-4 weeks
Note- These training sessions are mandatory by the Louisiana Department of Education, Refusing to attend, CAN will begin the Seriously Deficient Process. Your reimbursement check could be held until you attend on of the scheduled meetings
There may be extra mandatory training sessions given by the Sponsor (CAN)
If a provider fails to understand the required meal components
not serving at the scheduled meal times
not calling CAN when not participating
not keeping records up to date
Sanctions for Non Compliant Monitoring
Violations that warrant noncompliance during a monitoring visit:
Provider not home and did not notify the Sponsor (CAN)
Provider has no children present and did not notify the Sponsor (CAN)
Provider has more that six (6) children in attendance and did not notify the Sponsor (CAN)
Resident, non-resident children reported improperly
Non-Compliant with program meal patterns
No evidence of meals served during meal times
Determination of Serious Deficient Providers
When violations of Program rules and regulations or evidences, suspected or reported as specifically stated above, Serious Deficiency Process and Termination Process actions will be initiated IMMEDIATELY
Submission of false information on any program form
Submission of false claims for reimbursement
Simultaneous participation under more than one Sponsor
Provider employed other than CACFP without prior State approval
An imminent threat to the health or safety of children in care or to the public
A determination that the Provider has been convicted during the last seven (7) years of any activity that indicated a lack of business integrity
Any other circumstances related to the non-performance under the Sponsor-Provider Agreement, as specified by the Sponsoring Organization or the State Agency
Employment
Any Provider who fails to report outside employment, will be determined Seriously Deficient, and CAN will immediately begin the process of Termination
Overpayment
Any Provider that is overpaid will have the overpayment automatically deducted from their next reimbursement
Underpayment
Any Provider that is unpaid will automatically be reimbursed
Amendment
CAN has only 3 amendments per year. These amendments are used by us when we need to edit a claim. They are NOT used for submitting late menus.
Participation
You are NOT PARTICIPATING
When you are not home and someone other than you is serving the meal
When you claim your resident child(ren) and there is not at least one(1) non-resident child(ren) present
You are sick/Ill
You get fast food (McDonald’s) and serve it as your meal
You serve your meal early and not at your scheduled meal time
You are on Vacation, Etc.
Program Forms
Providers must comply with a USDA regulation which went into effect on 9/1/2009. You must maintain program records for three (3) years after the date of Submission. (see MEMO dated 8/26/2009).
Program records include meals, daily meal count and attendance report forms, for each month you participated, and each child’s enrollment form
When you are monitored, all menus and daily meal count records, for the month, must be given to the monitor for review. These records/forms must be kept in the kitchen or the dining room area. (They must be accessible).
The daily meal count and attendance report form must be signed and dated om the last day of the month, after the last meal is served
NOTE- If the form is signed in advance, CAN will not accept the menus or the daily attendance form. You will loose that month’s reimbursement
Menu records must be made available to CAN by the 3rd working day of the following month. Failure to do so may result in the loss of payment for that Month
Enrollment Forms
Any updated on Enrollment Forms require a new Enrollment Form
(Such as address change, parent’s employment, phone number, etc)
All Enrollment Forms are due in our office within three (3) working days after the parent has signed
Enrollment Forms must be written in ink ONLY. DO NOT use pencil
Do NOT use “Liquid Paper” or “Correction Tape” on Enrollment Forms, if you make a mistake, just put a line through it, initial and date
Meal Times
The last meal or snack of the day claimed for a child, must be served at least 30 minutes prior to the time the child leaves
You must begin serving your meal 15 minutes before the scheduled meal time (Use this time to start serving food on the plate, cool hot foods for small children, wash hands, or say blessing)
You can NOT use this 15 minutes to run errands (go to the store) or take care of personal business
School Aged Children
Breakfast cannot be approved unless the child has 30 minutes to eat the meal before leaving for school
If all of your enrolled children are in school, (eating lunch at school) you must call in to CAN and inform us whenever you ARE SERVING LUNCH
Pets
When you are monitored by CAN or the State Department, all pets must be removed from the monitoring areas. Your pets must be take to another closed room or put outside
Errands
Providers may take the children to run an errand. You must call to notify CAN, before you leave and when you return. You can NOT run errands during your scheduled meal times
NOTE- Remember when you run errands with the children, you are at risk for accidents, running late with a meal, or fail a monitoring visit
Pregnancy
An expecting Provider must inform CAN within 3 to 6 weeks before her due date
After delivery, she must inform us when she becomes ACTIVE
Field Trip
No field trips are allowed. You may take your children for a fun day, but at your own risk!! Remember to call in and report that you are not participating on that day
Fundraising
No one will be forced to do any fundraising for CHILDREN AND NUTRITION, INC.
